May 05, 2008, Leipzig: Autohaus Heil saved after initiation of insolvency proceedings: The insolvency administrator appointed by the Local Court (Amtsgericht) of Leipzig, Rainer M. Bähr, attorney at law, announced today, barely two months after the company filed for insolvency, that the operations of the well-known, longstanding Heil car dealership in Leipzig have been reorganized. August 06, 2007, Frankfurt am Main: A Fresh Start for peS Gesellschaft für medizinische Diagnosesysteme mbH - Investor acquires insolvent company - all jobs secured- "I am pleased that the negotiations went very successfully and that it was possible as a result to avert the potential breakup of peS GmbH. January 28, 2007, Frankfurt am Main: Break through in the reorganization of Georg von Opel Under the direction of the Insolvency Administrator, Mr. Ottmar Hermann, more than two-thirds of 730 jobs were able to be saved. A transitional company was founded for employees. Numerous subsidiaries were retained through new subsidiaries. The Bonn and Friedberg Point of Sales were sold. September 28, 2006, Frankfurt am Main: Reorganization of the Unternehmensgruppe Georg von Opel GmbH goes forward. Insolvency Proceedings are instituted – intensive negotiations with investors On September 28, 2006, the District Court for the City of Frankfurt am Main instituted Insolvency Proceedings against Unternehmensgruppe Georg von Opel GmbH. Attorney Ottmar Hermann was appointed by the court as Insolvency Administrator. Mr. Hermann had already led business operations of the car manufacturing group without restrictions during preliminary Insolvency Proceedings. The Unternehmensgruppe Georg von Opel GmbH filed a petition for insolvency protection on June 12, 2006 in order to obtain permanent reorganization under the German Insolvency Code. The goal is the continuation of core remedial business operations of Georg von Opel and the preservation of many jobs. "We see good chance for a reorganization of this company that has a longstanding tradition, because motivated employees, suppliers, satisfied clients as well as the Creditor Banks constructively support the Auto Sales Group," Mr. Hermann stressed. Presently, the Insolvency Law team of the HERMANN firm is leading intensive negotiations with domestic and foreign investors. Business operations in car dealerships and repair shops will be fundamentally sustained during the Insolvency Proceeding that has already opened. Thus, the new Opel Corsa will be presented within the next few days in the Georg von Opel show rooms.

January 26, 2006, Frankfurt am Main: Aero Flight GmbH & Co. Luftverkehrs-KG: Sales Agreement concluded with Icelandic Air-Group. Following intensive negotiations, the insolvent Aero Flight GmbH & Co. Luftverkehrs-KG, in association with the preliminary Insolvency Administrator, Ottmar Hermann (Attorney-at-Law), concluded a sales agreement for several assets for a newly founded German company of the Icelandic Air-Group. Through its new company name, the Air-Group intends to petition the German Federal Air Transport Authority (the LBA) for an operating license in order to carry out air transportation in the near future. At first, following the granting of the air permit, air transport is planned with two airplanes. On the other hand, the air transport company of Aero Flight GmbH & Co. Luftverkehrs-KG shall be dissolved. The sales agreement is currently under reserve of approval from the final Insolvency Administrator as well as the bodies of Creditors. The amount of the sales price has not been disclosed by either party. Having its headquarters in Oberursel, Aero Flight GmbH & Co.Luftverkehrs-KG submitted an Insolvency petition to the District Court in Bad Homburg on November 24, 2005 on account of difficulties meeting its payments.
November 29, 2005, Frankfurt am Main: The Aero Flight GmbH & Co. Luftverkehrs-KG Preliminary Insolvency Administrator begins his function. The District Court of Bad Homburg has appointed Frankfurt Attorney Ottmar Hermann as Insolvency Administrator for the Aero Flight GmbH & Co. Luftverkehrs-KG that is undergoing payment difficulties. In the meantime, the Insolvency Law team of the HERMANN law firm has assumed their duties at the offices of the airline company headquartered in Oberursel in order to immediately get a picture of the present situation as well as possible investors. Aero Flight lately has six Airbuses. The Company was founded in 2003 following the Insolvency of the venerable airline Aero Lloyd.
December 12, 2005, Leipzig: The Weimar Electric Wholesale saved from Insolvency. As the reorganization advisor who since the Spring of 2005 has advised WEHA-Elektro-Technischer Großhandel GmbH that is undergoing Insolvency Proceedings, upon order of the Insolvency Debtor, attorney Rainer M. Bähr compiled an insolvency plan. With only one dissenting vote, the Creditors’ meeting overwhelmingly approved the plan. After the District Court of Erfurt approves the insolvency plan in the meantime, the Insolvency Proceedings are almost ready to be discontinued. In 1990, WEHA- Elektro- Technischer Großhandel GmbH was founded from a regional wholesale cooperative company. Henceforth, the groundwork has been laid for the current ten employees and their strong, tight client-oriented company to prove their worth on the regional marketplace.

August 15, 2005, Frankfurt am Main: Mr. Hermann appointed as preliminary Insolvency Administrator in First Rail Property Insolvency Proceedings. In order to safeguard the assets of First Rail Property GmbH, the District Court of Darmstadt has ordered preliminary Insolvency Proceeding against the company. The Company has concluded a framework agreement with Deutsch Bahn AG and Deutsche Bahn Station & Service AG for the acquisition of 1,016 train stations and has already acquired 502 train stations by the end of 2004. October 12, 2004: Bosnian Insolvency Law wins top position according to the European Bank for Reconstruction and Development. A study on behalf of the European Bank for Reconstruction and Development (www.ebrd.com) has indicated Insolvency Law in Bosnia-Herzegovina conforms best to international standards of the youngest on-going law reforms in comparison to the law reforms of twenty-seven other former Warsaw Pact nations. The new Bosnia-Herzegovina Insolveny Law reform goes back considerably to a preliminary draft law written by the Partners of our Firm mandated by and in collaboration with the Working Group for Technical Co-operation (the "GTZ“) and the World Bank.
October 1, 2004, Karlsruhe: Reorganization of Aluminum Manufacturer from Karlsruhe. As Insolvency Administrator, Ottmar Hermann was successful in the reorganization and sale as of June 1, 2004 to Sommer Antriebs- and Funktechnik GmbH headquartered in Kircheim of Groke GmbH & Co. KG in Karlsruhe, a company with a long tradition spanning more than 100 years known in the specialized trade as a manufacturer of high-quality aluminum house entrance doors and aluminum windows following the opening of the Insolvency Proceedings that occurred at the end of December 2003. Groke will operate in the future under the name of Groke Tore und Türen GmbH. It will operate independently in the marketplace. 37 jobs were able to be protected in the long term by the sale. Through vertical product integration both companies are able to offer an attractive, full range of power trains, radio controls, doors and gates. For this reason the Insolvency Administrator contributed significantly to the establishment of an effective, sustainable company in the marketplace. |
